CITEC to sell to Queensland Government

CITEC is leading the IT industry after being given the green light to service Queensland public sector Information Communication and Technology (ICT) contracts.

The win follows the upgrade of CITEC’s accreditation from the Government Information Technology Conditions (GITC) Framework Version 2 to Version 5.

CITEC’s accreditation was effective from December 2005. The GITC Version 5 Agreement represents a suite of standard terms and conditions which forms the basis for Queensland Government’s procurement of ICT products and services.

This contractual document aims to protect both government and the ICT industry by ensuring that both parties address appropriate legal and contractual conditions for a government ICT procurement contract. The framework provides significant benefits to government agencies and the ICT industry. The primary objectives of the GITC Agreement are to:

  • substantially reduce the cost of procurement for government and the ICT industry through the use of pre-agreed terms and conditions;
  • provide contractual consistency, certainty and clarity across government’s ICT purchasing arrangements;
  • develop a flexible contractual framework which caters for emerging technologies and contractual issues (e.g. intellectual property rights, moral rights, telecommunications, and internet services); and
  • provide a fair contractual environment for the ICT industry to do business with the Queensland Government, irrespective of size (e.g. small to medium enterprises (SME’s) or large multi-nationals).

Denis Hurley, CITEC’s Manager of Legal and Contractual Services advised that GITC Version 5 was a standard form of agreement whereby suppliers of ICT products and services pre-agree to use a standard set of contractual terms and conditions in their commercial dealings with government agencies.

“Version 5 provides clearer terminology and definitions. There is a flexible intellectual property regime and more realistic insurance provisions,” Denis said.

“CITEC’s agreements with existing Queensland Government clients using GITC Version 2 are still binding and will not be affected unless the contracting parties explicitly agree to vary the terms and conditions to GITC Version 5.”
